Buying a Studio Off-Plan or Ready to Move In: What Changes for Your Investment
This decision affects your cash flow, the time until your first income and your level of risk. Let's compare the two paths.
Off-plan vs. ready
| Criteria | Off-plan | Ready |
|---|---|---|
| Entry price | Lower | Higher |
| Payment | Installments during construction, adjusted by INCC | Cash or mortgage |
| Time to income | Months to years | Immediate |
| Delay risk | Exists | Not applicable |
| Appreciation until delivery | Can be captured | Already priced in |
| Cancellation | Penalty of up to 25% or 50% (Cancellation Law) | Regular sale negotiation |
How off-plan payment works
A common model in Rio is the 30/70 plan: about 30% paid during construction and 70% when the keys are delivered, paid in full or financed. Many launches offer installments directly with the developer, without a bank credit check, over 3 to 4 years of construction. Note: these installments are usually adjusted by the INCC during construction and, after delivery, usually by inflation (IPCA) plus interest.
With high interest rates (Selic at 13.75%), financing the balance at delivery is expensive. So plan from the start how the 70% will be paid. For buyers abroad, mortgages in Brazil are rare: plan to pay this balance with your own funds.
The main risk: construction delays
It is real, but it can be reduced:
- Ring-fenced project (patrimônio de afetação), under Law 10,931/2004: separates the project's money from the developer's cash and protects buyers if the company runs into trouble
- Developer track record: check past deliveries and talk to previous buyers
- Grace period: the law allows up to 180 days of delay; after that, the buyer can cancel with a full refund or claim compensation

When ready-to-move-in makes more sense
If you want immediate income (long-term rental or Airbnb) or prefer to eliminate construction risk, buying a finished unit is the most direct path, even with a higher entry price and payment in cash or by mortgage.
Off-plan or ready is not about which is "better", it is about risk and timing. Those in a hurry for income tend to prefer ready units; those with patience who want a lower entry price tend to benefit from off-plan. The mistake I see most is buying off-plan without checking the developer's record and without planning how to pay the balance at delivery.
Practical summary
- Off-plan: lower entry price, payments spread with INCC adjustment, possible appreciation, delay risk
- Ready: higher entry price, immediate income, no construction risk
- Off-plan, check the ring-fenced structure, the developer's record and how you will pay at delivery

Frequently asked questions
Is buying off-plan cheaper?
Usually yes: the entry price is lower and payments are spread over construction. But installments are usually adjusted by the INCC (Brazil's construction cost index), and the final price per m² may approach the market price at delivery.
What is the main risk of buying off-plan?
Delivery delays. Brazilian law allows a grace period of up to 180 days; beyond that, the buyer has rights. The risk is lower with developers that have a track record and projects with a ring-fenced structure (patrimônio de afetação).
What if I give up on an off-plan purchase?
Under Brazil's Cancellation Law (Law 13,786/2018), the developer can keep up to 25% of what was paid, or up to 50% when the project is ring-fenced, plus the brokerage fee. So only buy if you are sure about the payment plan.
Does buying a finished unit remove all risk?
It removes construction risk, but not market risks such as price swings or rental vacancy.
